Welcome to Awaaz FM ("Platform", "We", "Us"). We are committed to protecting your privacy. This policy explains how we collect, use, and safeguard your data. By using Awaaz FM, you consent to the practices described in this policy.

2. Information We Collect

A. Information You Provide

• Account Data: Name, Mobile Number, Date of Birth (Required for Age Verification), Gender, Password.
• Creator Data (For Payouts): PAN Card, Bank Account Details, GST Number. Financial data is processed via secure Payment Gateways; we do not store raw banking passwords.
• User Content: Videos, audio, comments, captions, and messages.

B. Information Automatically Collected

• Device Information: Device ID, Model, OS Version, IP Address.
• Usage Logs: Watch history, search queries, interaction logs.
• Location: Coarse location (City/State) derived from IP address. We do not collect precise GPS without permission.

3. How We Use Your Data

1. Service Delivery: To stream videos and enable uploads.
2. Safety: To enforce 13+ consumption and 18+ monetization limits.
3. Monetization: To deduct Tax Deducted at Source (TDS) and process payouts.
4. Security: To detect fraud, spam, and illegal content.
5. Advertising: To serve ads. We do not track behavior for ads on users under 18.

4. Data Retention (Legal Hold)

Active Accounts: Data retained while account is active.

Deleted Accounts: In compliance with CERT-In Directions (2022), we retain user logs and registration data in a secure archive for 180 days after deletion to aid in cyber-crime investigations. After this period, data is permanently purged.

Terms of Service

1. Acceptance of Terms

By using Awaaz FM, you agree to these Terms. You must be at least 13 years old to use the platform. If you are under 18, you must have parental consent. Monetization is strictly for users 18+.

2. Intermediary Status

Awaaz FM is an "Intermediary" under the Information Technology Act, 2000. We do not pre-censor content and are not liable for User Generated Content (UGC). We act as a passive host.

3. Prohibited Content (Rule 3(1)(b))

You agree NOT to upload content that:

• Belongs to another person without rights.
• Is obscene, pornographic, or harmful to children.
• Infringes copyright or trademark.
• Deceives about origin or contains Deepfakes/Misinformation.
• Threatens the unity, integrity, or security of India.

4. Content License

You retain ownership of your content. By uploading, you grant us a worldwide, royalty-free license to display, distribute, and promote your content on the platform.

5. Termination

We employ a Three-Strike Policy for violations. We reserve the right to terminate accounts immediately for severe violations (e.g., Terrorism, Child Safety).

6. Dispute Resolution

Users: Disputes subject to courts in New Delhi.
Creators: Commercial disputes subject to Arbitration in New Delhi.

Community Guidelines

1. Safety First

Child Safety: Zero tolerance for CSAM. We report to NCMEC/CBI.
No Violence: Do not post content encouraging violence or self-harm.

2. Sexual Content

Explicit pornography is prohibited. Artistic/Mature themes must be age-gated (18+).

3. Copyright

Only upload what you own. Use the Awaaz Sound Library for music. Unauthorized use of copyrighted movies/music will result in a strike.

4. Misinformation

Do not spread fake news causing real-world harm. AI-generated realistic videos must be labeled as "AI Generated".

Creator Monetization Policy

1. Eligibility

You must be 18+ and provide a valid PAN Card and Indian Bank Account. You are an Independent Contractor.

2. Revenue Share

You receive a share of Net Revenue.

Net Revenue = Gross Revenue MINUS Store Commissions (Google/Apple fees), GST, and Gateway Fees.

Split: Awaaz FM (30%) / Creator (70%) of Net Revenue.

3. Taxes

We deduct TDS at applicable rates (10%) under Section 194J/194R. You are responsible for your own GST filings if turnover exceeds ₹20 Lakhs.

4. Clawback

We may withhold or reclaim payments in cases of fraud, bot traffic, or chargebacks.

DMCA & Copyright Policy

1. Takedown Policy

We remove infringing content within 36 hours of receiving a valid notice.

2. How to Report

Email connect@awaazfm.in with:

• Description of copyrighted work.
• URL of infringing material.
• Your contact details and a statement of good faith belief.

3. Counter-Notice

If your content was removed by mistake, you may file a counter-notice consenting to the jurisdiction of courts in New Delhi (for India) or US Federal Courts (for International).
